What you need to know

Prime is reminding clients of the Arkansas Insurance Department’s (AID) reporting requirements under Arkansas Rule 128. The due date for this reporting is March 1, 2026, and data will be reflective of Jan.1, 2025 - Dec. 31, 2025. 

Similar to submission requirements in 2025, Prime recommends that clients review next steps and inform us if you do not want Prime to provide reporting data to AID by Feb. 20, 2026. If no request is received, we will submit data to AID on your plans’ behalf prior to the March 1, 2026 submission deadline.

Overview

As outlined in Prime’s previous communications — February 2025, April 2025 and June 2025 — the Arkansas Pharmacy Benefit Manager Licensure Act governs the oversight of pharmacy benefit managers (PBMs) operating within the state of Arkansas. In 2024, the Arkansas Insurance Department (AID), issued updated regulations and guidance related to pharmacy reimbursement practices and data reporting requirements. 

Arkansas Rule 128 and the Bulletin #18-2024 require that “health benefit plans” and “healthcare payors” submit pharmacy reimbursement data to AID. Under Arkansas law, reporting is requested for essentially all types of prescription drug plans, including those offered by an insurer, a health maintenance organization (HMO) or any entity providing coverage on a self-funded basis (including governmental plans). They also expressly include any “group plan, policy, or contract for healthcare services issued outside [Arkansas] that provides benefits to residents of [Arkansas].”  

Next steps for March 1, 2026 reporting deadline

While our reporting approach remains compliant with AID’s expectations, we are recommending clients take the following proactive steps:

  • Similar to the initial submission process, if your plan does not want Prime to provide reporting data to AID, please notify us at GPReportingInquries@PrimeTherapeutics.com by Feb. 20, 2026.
  • If your request to not submit is specific to a particular line of business (Fully Insured, ACA, Self Insured) please identify that in your request.
  • If we do not receive direction from you by the Feb. 20, 2026 deadline, Prime will proceed with submitting the required data on your behalf.
